Marshmallow Messenger: Referral Program Terms & Conditions
PLEASE READ THESE REFERRAL TERMS CAREFULLY.
This "Agreement" (these referral terms on this page together with the documents referred to in it) sets out the terms which govern our referral programme (the "Referral Programme"). Please read this Agreement carefully before you use our Referral Programme. By using our Referral Programme, you confirm that you accept this Agreement and that you agree to comply with it.
If you do not agree to the terms of this Agreement, you must not use our Referral Programme. This Agreement applies whether you are a person sharing a referral link or code ("Messenger", "Referrer", "you") or a person introduced by a Messenger to purchase a Marshmallow insurance policy ("Friend", "Referee").
By sharing your unique referral code, you agree to be bound by these Terms and the Marshmallow Messenger Code of Conduct.
Marshmallow reserves the right to amend, withdraw, or change the discount amounts and cash reward structures at any time without prior notice.
1. Referrals
1.1 Referral Programme and Referral Reward
Subject to your compliance with the terms of this Agreement, Marshmallow shall send you and/or your Friend a reward as specified on the Referral Programme page and/or in any related materials we refer to (the "Referral Reward").
The Referral Programme page specifies rules including (without limitation) how many Friends you need to invite, the amount and/or type of Referral Reward you may be entitled to, and the conditions attached to the Referral Programme.
The Referral Reward (including any monetary reward and/or any discount offered to Friends) may change from time to time, may vary between Messengers and/or Friends, and may be subject to additional eligibility criteria.
1.2 Referral Code
You may use the Referral Programme by sharing a code that is unique to you, is sent from us where one can request a quote and/or purchase a Marshmallow insurance policy and allows Marshmallow ("us", "our") to link the referring Messenger to the policy purchased.
1.3 Repeat Referrals / Limits
Provided that you meet the requirements (as in force at that time) more than once, you may be entitled to Referral Rewards each time you meet such requirements, subject to any limits set out on the Referral Programme page.
We may disallow you from using your Referral Code to introduce new Friends and earn rewards from those introductions if we reasonably believe you have breached this Agreement, acted in bad faith, or engaged in misuse of the Referral Programme.
2. Referral Reward
For each Friend who has used the Referral Code to purchase a Marshmallow policy and meets the criteria below, we will send the Messenger and/or the Friend the Referral Reward as specified on the Referral Programme page at the time the Friend purchases. We reserve the right at any time to withhold, delay or decline payment for Referral Rewards where reasonably necessary for the purposes of fraud prevention, verification, anti-money laundering, sanctions screening or compliance with applicable law.
2.1 Conditions for Referral Reward ("Successful Referral")
A referral will be eligible for a Referral Reward only if all of the following conditions are met:
- the Friend does not cancel or have their policy cancelled within 14 days after the policy starts (or any time before the policy starts) (the "Cooling-Off Period");
- the Friend has not previously bought a policy with Marshmallow as a policyholder;
- the Friend purchased the insurance policy from a quote that was generated via the Messenger's Referral Link (and not via Marshmallow's homepage or any generic quote flow);
- neither the Messenger nor the Friend is in arrears on any payments owed by them to Marshmallow under the terms of a Marshmallow policy;
- neither the Messenger nor the Friend has a claim under the terms of a policy with Marshmallow;
- If we have requested any verification information or documents from the Messenger or the Friend, the documents have been satisfactorily provided to us and approved by our team.
2.2 When We Will Not Send a Referral Reward
We will not send out any Referral Reward to the Messenger or the Friend if:
- the Friend currently has or has had a policy (where the Friend is a policyholder) with us in the past;
- the Messenger and the Friend are the same person (including referrals made using alternative contact information);
- the Friend purchased the insurance policy from a quote that was not generated via the Referral Link;
- either the Friend or the Messenger is or subsequently falls into arrears in respect of any payments owed by them to Marshmallow under the terms of a Marshmallow insurance policy (including but not limited to cancellation fees when applicable); or
- we suspect in our sole and absolute discretion that you have breached the terms of this Agreement in connection with paragraph 6.1 below.
2.3 Validation and Payout Timing
Referral Rewards are only "validated" once the Friend's policy has remained active past the Cooling-Off Period.
Subject to the terms of this Agreement, we will send the Referral Reward within the timeframe stated on the Referral Programme page (or as communicated to you), once all conditions for the Referral Reward are met.
Rewards will only be paid once validated by us and once we have completed any required verification checks. Payment may be delayed where additional checks are required.
2.4 Payout Conditions and Timing
- Rewards are "Validated" only after the 14-day cancellation period passes.
- Once validated, rewards are processed monthly in arrears, typically within 30–60 days. Rewards will be paid by bank transfer to the details you provide. You are responsible for ensuring your details are accurate and Marshmallow shall have no liability to you where you provide inaccurate or incomplete information.
- No rewards will be issued if the Referrer or Friend is or subsequently falls into arrears in respect of any payments owed by them to Marshmallow under the terms of a Marshmallow insurance policy.
- You are responsible for any taxes due in connection with any Referral Rewards you receive.
2.5 Changes to Referral Reward and Friend Discounts
Marshmallow may amend, replace, remove or withdraw any Referral Reward (including any monetary reward and any Friend discount) at any time.
Any Referral Reward will be determined by the offer shown on the Referral Programme page (or as communicated by us) at the time the Friend purchases using the Referral Link, subject always to the successful completion of our internal validation and fraud controls.
3. Prohibited Uses
3.1 Acceptable Use
You may only use our Referral Programme in good faith for lawful purposes. You may not:
- create more than one account or identity in order to invite yourself;
- invite others that have purchased duplicate policies;
- use alternative contact information to refer yourself or others that have purchased duplicate policies;
- invite an existing customer of Marshmallow or anyone who has previously held a policy with Marshmallow as a policyholder;
- invite fictitious persons;
- do anything that damages Marshmallow's brand, goodwill or reputation;
- use the Referral Programme in: (i) any way that breaches any applicable local, national or international law or regulation; or (ii) any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- transmit any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
- transmit any unsolicited or unauthorised advertising either via paid search or any other similar activity, including channels that can damage the Marshmallow brand, goodwill or reputation;
- post your Referral Link on voucher, coupon or discount aggregation websites or similar "deal sharing" platforms;
- make any misleading, exaggerated, or unsubstantiated claims about Marshmallow, including claims about pricing, acceptance, eligibility, coverage, or discounts;
- present the Referral Programme as a job, guaranteed income, or investment opportunity
- offer additional incentives outside of the Referral Programme (for example "cash back", gifts, or rebates to Referees) to persuade someone to use your Referral Link
3.2 Responsibility for Misuse
Any obligation on you not to do something includes an obligation not to allow that thing to be done. You are responsible for ensuring anyone acting on your behalf complies with these Terms.
4. Identification Documents
4.1 ID Checks
Marshmallow may require identification documents from you prior to sending you any reward related to a successful referral.
4.2 Withholding Rewards
Marshmallow shall not be in breach of this Agreement (nor have any obligation to pay you any reward related to a successful referral) if you do not (in Marshmallow's sole and absolute discretion) provide the identification documents requested by Marshmallow.
5. Data Protection and Privacy
You represent and warrant to us that you have obtained the express consent from Friends before sharing any referral link or code from us with them.
You must not collect, store or share any Friend's personal data, financial information, or documents for the purpose of the Referral Programme. Friends should be directed to Marshmallow to complete their quote and purchase journey directly.
Marshmallow will process personal data in accordance with its Privacy Policy. Where required, Marshmallow will act as an independent controller for personal data submitted by Friends.
6. Abuse of Referral System
6.1 Fraud and Misuse
Marshmallow has the right to refuse to pay you the Referral Reward if (in its sole and absolute discretion) Marshmallow suspects that you have not used the Referral Programme in good faith or have breached this Agreement.
6.2 Enforcement
We will determine, in our sole and absolute discretion, whether there has been a breach of this Agreement. When a breach of this Agreement has occurred, Marshmallow may take such action as we deem appropriate, including (but not limited to) termination of this Agreement, cancelling any related insurance policy or policies (where permitted), and suspending or terminating the Referral Programme. You are not allowed to:
- Self-Referral: Create multiple accounts to refer yourself.
- Spamming: Use paid search (e.g., bidding on "Marshmallow" keywords) or post on coupon/discount sites. You must only share the Referral Link with people you know or who would reasonably expect to receive it, and must stop contacting anyone who asks you not to.
- Targeting: You must not target insurance-specific cohorts or provide persuasive sales tactics in contravention of our messaging guidance shared with you. In particular, you must not target vulnerable individuals, use high-pressure tactics, or make insurance-specific claims about suitability, acceptance, pricing, or outcomes. You must not act as a sales representative to Friends or handle objections on their behalf
- Privacy: You must not collect or store the personal or financial information of the people you refer.
- Financial Promotions: You must not create your own marketing materials about Marshmallow without our prior written approval.
7. Compliance: Information-Only and Signposting
7.1 No Insurance Advice
This Referral Programme is a marketing introduction programme only.
Messengers are not authorised to provide insurance advice and must not act as representatives of Marshmallow. You must not:
- provide advice or recommendations about insurance policies;
- discuss suitability or personalised pricing;
- help anyone complete or conclude contracts;
- state or imply that you are authorised by Marshmallow to advise on or arrange insurance; or
- represent yourself as acting in any way on Marshmallow's behalf.
7.2 Mandatory Disclaimer
Where you share Referral Links or Referral Programme messages, you must ensure Friends receive the following disclaimer:
"I'm a Marshmallow Messenger and I earn a reward for successful referrals. I cannot provide insurance advice; please visit Marshmallow's website directly for pricing, product information and full terms".
8. WhatsApp Community: Code of Conduct
This is a Broadcast only channel participation where the Referral Programme involves WhatsApp or other community channels:
- Participation is optional;
- Any Marshmallow WhatsApp content will be broadcast-style informational messaging;
- there are no posting requirements, quotas, leaderboards, or targets;
- Messengers must not use these channels to provide advice, handle objections, or act as a sales representative and must comply with WhatsApp's policies and terms of use at all times.
9. Limitation of Liability
Marshmallow accepts no liability for any loss arising from your breach of this Agreement or misuse of the Referral Programme. Nothing in this Agreement limits or excludes any liability that cannot be limited or excluded by law.
10. Changes to the Agreement
We may revise this Agreement at any time by amending this page. Your continued use of the Referral Programme after such changes take effect shall amount to acceptance of the Agreement in force at that time.
11. Changes to the Referral Programme
Marshmallow reserves the right to:
- amend, alter or change the Referral Programme at any time, without notice (including the amount and type of any Referral Reward); and
- terminate the Referral Programme at any time, without notice.
In the event the Referral Programme is terminated, Marshmallow will not be obliged to pay Referral Rewards to any persons that would previously have been eligible for a Referral Reward.
12. Applicable Law
12.1 Governing Law
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
12.2 Jurisdiction
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
